From class selection to handling objections — how to register your trademark in India with realistic timelines and cost breakdowns.
Why Your Brand Needs Trademark Protection
A trademark gives you the exclusive right to your brand name, logo, or slogan. Without it, a competitor can legally use a similar name — or you could receive a cease-and-desist from someone who registered first.
What Can Be Trademarked?
- Brand names and word marks
- Logos and device marks
- Slogans and taglines
- Product packaging (trade dress)
Step 1: Trademark Search
Search the Indian Trademark Registry (ipindia.gov.in) for identical or similar marks. A strong search prevents wasted filing fees and opposition.
Step 2: Select the Right Class
Key classes for startups:
- Class 9 — Software, apps, electronics
- Class 35 — Business services, e-commerce
- Class 36 — Financial services, fintech
- Class 42 — IT services, SaaS
Step 3: File the Application
File online via ipindiaonline.gov.in. Government fee: ₹4,500/class (individuals/startups), ₹9,000/class (companies).
Step 4: Examination & Publication
Registry examines within 30-90 days. If accepted, published in the Trademark Journal for a 4-month opposition period.
Step 5: Handle Objections
If objected, file a counter-statement within 30 days. Our team drafts strong replies with arguments and evidence — hearings attended on your behalf.
Step 6: Registration Certificate
If no opposition, registration certificate issued. Valid for 10 years, renewable indefinitely. Use ™ from filing date, ® only after registration.
Realistic Timeline
Uncontested: 18-24 months. Contested: 3-5 years.
